Аннотация
В настоящей работе, вышедшей в 1979 г., Ричард Познер впервые представил свою оригинальную теорию права — теорию максимизации благосостояния. Работа состоит из нескольких частей. В первой части работы рассматриваются несколько предварительных проблем, в том числе различие между позитивным и нормативным анализом и установление критерия предпочтения между этическими теориями. Вторая часть, которую Ричард Познер считает главной, посвящена различиям между утилитаризмом и максимизацией благосостояния как нормативных систем, а также краткому рассмотрению кантианского подхода. Судья Познер делает акцент на том, что разница между способностью к получению удовольствия и производительным трудом на благо окружающих является ключом к различению утилитаризма и максимизации благосостояния как этических систем. Также в статье имеются четыре приложения, в которых рассматриваются некоторые нормативные споры о праве с точки зрения экономического анализа, тщательно отделяемого автором от утилитаризма. В частности, Познер подробно анализирует проблему смертной казни, право на неприкосновенность частной жизни, вопросы личных свобод, рыночный подход к усыновлению детей и приобретению донорских органов.
