Ответственность за вред, причиненный малолетними: сравнительно-правовое исследование

В статье проводится исследование деликтных обязательств, возникающих в случае причинения вреда несовершеннолетним, не достигшим 14 лет. Изучен опыт стран, законодательство которых не предусматривает общего правила о неделиктоспособности малолетнего; сделан вывод о том, что и в этих странах судебная практика учитывает способность или неспособность несовершеннолетнего понять неправомерность своих действий или вероятность причинения вреда. При определении лиц, ответственных за вред, причиненный малолетним, высказано предположение о том, что под лицами, осуществляющими надзор на основании договора, не следует понимать родственников или друзей семьи, присматривающих за ребенком в качестве безвозмездной услуги. Напротив, коммерческие организации, оборудующие место для игры детей, автоматически становятся обязанными осуществлять надзор, так же как и лица, на основании возмездного договора оказывающие образовательные, развлекательные, медицинские и иные подобные услуги ребенку. Под договорами, в силу которых лицо обязано осуществлять надзор, предлагается понимать либо возмездные договоры, либо безвозмездные договоры, сопутствующие процессу заключения возмездного договора с потребителем (детские комнаты в универмагах, ресторанах и т. д.). Обсуждается необходимость привлечения к ответственности за вред, причиненный малолетним, не только родителей, но и лиц, фактически осуществляющих воспитание (к числу которых относятся, например, отчим или мачеха ребенка).
