Modern concepts of law in the context of dynamics of scientific paradigm
Abstract
The article attempts to understand the reasons for and the place of the modern legal concepts in the context of the legal culture which is seen as a set of several co-existing legal subcultures. Law in the context of a classical paradigm and law in the context of a non-classical paradigm is partially or completely existing in time. It is a linearly concept of scientific development, and various research paradigms co-exist within the same time continuum. It is possible to relate these paradigms with the vectors of general cultural development only by analyzing certain legal concepts in terms of using terminology, research methods, research styles which are part of the dominant cultural paradigm of a particular historical epoch. The classics are a kind of a constant, something eternal and unchangeable within the culture, including the legal culture. Concurrent with the classical paradigm that has been existing at all times, other paradigms coexist in the same time space reflecting certain cultural features of a particular time continuum. Legal concepts that do not fit into the classical law refer to the modern legal culture, to the postmodern legal culture, and today even to the postpostmodern legal culture. This multifaceted character of the paradigm is necessary to preserve and develop the national legal culture. Reduction to a common denominator is impossible because the advocates of a particular type of law understanding rely on different disciplinary matrices. Each of the existing legal concepts has a right to exist and the right to the truth, contextual in time and place. But none of them can claim to possess apodictical knowledge as law, being a cultural phenomenon, continues to grow along with other cultural phenomena. The aim of this deliberation is a proposal for discussion in the spirit of a tradi tional Russian essay culture rather than an attempt to reconcile the antagonistic positions or positioning of the ultimate truth.
