Legal logic, problems, and ways to improve credit management on e-commerce platforms in China

Abstract

Against the backdrop of the rapid development of e-commerce, credit management becomes especially important for ensuring order on platforms and promoting their high quality. This article analyzes the internal logic of credit management on e-commerce platforms, the challenges it faces, and possible solutions. The article notes that the traditional model of management, which focuses on punishment for breach of trust and ignores the encouragement of good-faith participants, leads to insufficient effectiveness in credit management on platforms. Additionally, delays in the development of technical tools and insufficient transparency of information create problems such as the “black box” of algorithms. To address these issues, the article suggests emphasizing the coordination between the encouragement of good-faith participants and the punishment for breach of obligations, promoting the participation of multiple stakeholders in platform governance, and utilizing informational tools to increase the availability and exchange of credit information. It is also noted that platform accountability for dishonest behavior can be strengthened through the introduction of legal mechanisms, clarifying the legal obligations of parties, and enhancing the legal force of restrictions, which will help create a more fair and transparent credit management system. By addressing these problems, the article aims to promote the high-quality development of e-commerce and contribute to the formation of a trusted digital economy.
