Правотворчество и когнитивные науки

дигму правотворчества в условиях насыщенной противоречивыми данными и нестабильной информационной среды. Обозначаются перспективы исследования познавательной деятельности юристов на основе методов, характерных для когнитивных наук, а также установленных в этих науках закономерностей. Междисциплинарные исследования когнитивных процессов могут способствовать выявлению допустимой частоты изменения закона, дающей пользоваться им как инструментом регулирования поведения человека, а также определению периодов времени, достаточных для выработки нормативных решений. Междисциплинарные исследования мозга могут способствовать определению реакции человеческой психики на фактор новизны в текстах нормативных правовых актов, установлению возрастных изменений в понимании и усвоении новых нормативных установок, происходящих ввиду изменения нейропластичности мозга. Анализ причин рецепции поведенческих нормативов из иностранных правопорядков в контексте имеющихся знаний о механизмах подражательного поведения может способствовать увеличению качества законодательства. Междисциплинарные исследования языка должны способствовать разработке алгоритмов связывания естественных и искусственных языков, выработке мер по совершенствованию текстов законов, написанных для человека, позволяющих адаптировать их для компьютера, могут предложить методику использования искусственного интеллекта для проверки текстов законов, подготовленных людьми. Когнитивное моделирование позволит установить возможность и целесообразность использования режима мультимодальной подачи нормативной информации (совмещения текста и графики), установить и уменьшить негативное влияние на качество юридических решений цифровой среды, в которой они принимаются, определить позитивные и негативные последствия широкого использования справочных правовых систем. Сформулирован вывод, что исследования закономерностей познавательной деятельности человека на основе правового материала и изучение реакций психики человека на изменение нормативных установок должны осуществлять преимущественно специалисты в области когнитивных наук, а разработку проектов нормативных правовых актов — коллективы юристов, учитывая при этом данные из иных областей знания, в том числе достижения когнитивных наук. Коллективное познание правовой действительности, эффективное сотрудничество юристов с иными специалистами возможно на основе разработки, конкретизации и соблюдения принципов научной коммуникации, гарантирующих разнообразие подходов к решению научных проблем, признание важности проверки и уточнения существующего знания, освещение передового опыта научного сотрудничества и достижений научных коллективов.
