Abstract
The review characterizes the textbook of S. A. Kurochkin “Arbitration Proceedings and International Commercial Arbitration”. It is noted that the author of the textbook seeks to develop an integrated approach to these phenomena. It is emphasized that the reviewed book has been prepared after the completion of the arbitration reform which makes it relevant. It is stated that the textbook focuses both on theoretical and practical aspects of this legal institute. In particular, the author has prepared recommendations for the compilation of certain documents necessary for the proceedings. The review notes that S. A. Kurochkin is developing his own ideas set out in the previous works. It is stated that the textbook presents main concepts of arbitration. The author uses a wide range of foreign sources. The review notes that the author in presenting the material according to the traditional approaches. The structure of the textbook corresponds to the legislator’s logic. The review points out that the author pays special attention to the issue of public order. This issue is extremely important for the institution of arbitration, since it is associated with a substantial part of the case law, including those relating to the refusal of recognition and enforcement of foreign judgments and arbitral awards. At the same time, the review notes that not all of the author’s concepts were supported by the legislator. In particular, it concerns the author’s proposals relating to the exclusion agreement.
