Abstract

The article discusses the issues of recognition of individual digital objects as objects of property law. The author offers civil law researchers an approach that involves not only considering and analysis the inherent properties and qualities of digital objects, but also in various aspects explores the space in which they exist. Classical civil law, as a rule, assumes that only objects that are limited in space, the length of existence in time, individual certainty, the possibility of appropriation, exclusivity of ownership and economic value (the ability to provide consumed and non-consumed benefits) can be extended to a material legal regime. The article contains an attempt to prove that due to the specifics of the modern understanding of space, such objects exist on the Internet, which can be called a digital environment, cyberspace, virtual space, electricspace, ecosystem etc. At the same time, it is imperative to keep in mind that a single human habitat, which determines civil circulation, most often designated as reality, now includes the information technology or digital sphere. Human life, economic activity and legal relations are currently hybrid in nature and are mediated by computer technology. Some historical analogies are also carried out, revealing general trends and prospects for economic and civil development. The author of the article proceeds from the premise that the content of legal relations has not changed since the time of Roman law, but the material side of legal relations has changed significantly, to the extent that the actual behavior of people has been technologized and transformed in accordance with the laws of the modern human environment. On the other hand, the properties and qualities of digital objects such as NFT and Ordinals are analyzed from the point of view of their technical and economic characteristics.
