Review of the monograph by I. A. Isaev, "Myths of the law. Law and literature" (M.: Prospekt, 2016)
Abstract
In his new book professor I. A. Isaev considers the interaction between the Literature and the Law. The author is a leading representative of the metaphysical school within the Russian philosophy of law. He explores the supra-positive context underlying legal notions and legal phenomena in general. Based on the empirical material of literary and philosophical texts, the author proves that the imagery and aesthetic categories (which were connected with perception of the legal realities in the period of their formation and development) are still vivid nowadays. This approach helps to identify not only historical and ontological origins of law. It reveals, in particular, an unexpected aspect of such phenomena as “mono-norm” and “legal syncretism”.
